AI notes: On July 16, 1937, the New York Court of Appeals upheld Lucky Luciano’s 1936 conviction for compulsory prostitution in People v. Luciano (277 N.Y. 348), affirming all 62 counts against him. The Court ruled that evidence of a conspiracy among Luciano and his associates was admissible, and that multiple joined counts were proper because they arose from a common scheme. Although Luciano did not personally perform every act, he was held criminally responsible as the leader of the prostitution enterprise. Chief Judge Frederick E. Crane authored the opinion, with participation from other judges, including Benjamin N. Cardozo, though it is unclear if Cardozo wrote a separate concurring opinion. The decision solidified the principle that leaders of organized crime operations could be held liable for acts committed by subordinates.
