Supreme Court case of Dartmouth v Woodward...

Item # 688847

February 10, 1819

THOMAS'S MASSACHUSETTS SPY OR WORCESTER GAZETTE, February 10 and 17, 1819

* Dartmouth College v Woodward
* United States Supreme Court

A two issue set
on the historic Supreme Court case of Dartmouth College vs. Woodward.
This was a landmark decision in U.S. corporate law from the United States Supreme Court dealing with the application of the Contracts Clause of the Constitution to private corporations. The case arose when the president of Dartmouth College was deposed by its trustees, leading to the New Hampshire legislature attempting to force the college to become a public institution and thereby place the ability to appoint trustees in the hands of the governor of New Hampshire.
The Supreme Court upheld the sanctity of the original charter of the college, which pre-dated the creation of the State.
The decision settled the nature of public versus private charters and resulted in the rise of the American business corporation and the American free enterprise system.
The February 10 issue has a brief report giving the decision of the Supreme Court, and the February 17 issue offers further particulars on the decision (see photos).
Both issues are complete in 4 pages, never bound nor trimmed, some foxing at front page folds, generally good condition.
